Terms of Sale (Public Offer)

Effective October 27, 2026

This document is a public offer (a public contract under Articles 633, 641 and 642 of the Civil Code of Ukraine) made by Individual Entrepreneur (FOP) Alina Hryhorivna Bezsmertna (the "Seller") to any person (the "Buyer") to purchase the digital product CLEAR 31 on the website clear31.com (the "Website") on the terms below.

1. Acceptance

  1. The Buyer accepts this offer by paying for the Product. From the moment payment is completed, the contract between the Seller and the Buyer is concluded on these terms.
  2. By paying, the Buyer confirms that they have read and agree to these Terms, the Refund Policy and the Privacy Policy, and that they are an adult with full legal capacity.

2. Product

  1. The "Product" is CLEAR 31, a digital wellness planner: a ZIP archive containing a 52-page printable PDF, a hyperlinked digital PDF for tablet apps, and bonus image files, as described on the Website.
  2. The Product is delivered electronically only. No physical goods are shipped.
  3. The Product is a general wellness tool. It is not medical advice, diagnosis or treatment, and does not replace consultation with a doctor or other qualified professional. People who drink heavily or daily should consult a doctor before stopping, because stopping suddenly can be unsafe.

3. Price and payment

  1. The price is shown on the Website at the time of purchase (currently $7.99). Prices may change, but a change does not affect orders already paid.
  2. Payment is made by Visa or Mastercard card, Apple Pay or Google Pay through the payment service provider WayForPay. Card details are entered on WayForPay's payment page and are not received or stored by the Seller.
  3. If the Buyer's card is in a currency other than the payment currency, the Buyer's bank may apply its own conversion rate and fees. The Seller does not control these.

4. Delivery

  1. After successful payment, the Buyer is shown a download link. The Seller may also send the link to the email address given at checkout.
  2. If the Buyer has not received access within 24 hours of payment, they should contact the Seller at bessmertnaya1609@gmail.com, and the Seller will provide access.
  3. The Buyer is responsible for having a device and software able to open ZIP and PDF files.

5. Licence and intellectual property

  1. All rights to the Product, including text, design and images, belong to the Seller.
  2. The Seller grants the Buyer a personal, non-exclusive, non-transferable licence to use the Product for personal, non-commercial purposes, including printing copies for personal and household use.
  3. The Buyer may not resell, share, distribute, publish, upload to file-sharing or marketplace sites, or use the Product or any part of it commercially. Sharing the bonus story cards on the Buyer's own social media is allowed.

6. Right of withdrawal and refunds

  1. The Product is digital content supplied immediately after payment. By completing the purchase, the Buyer requests immediate supply and acknowledges that, to the extent permitted by applicable law, the right to withdraw from the contract ends once the download link has been provided.
  2. Refunds are available in the cases listed in the Refund Policy.

7. Liability

  1. The Seller is not responsible for the Buyer's health decisions or results. The Buyer uses the Product at their own discretion.
  2. To the extent permitted by law, the Seller's total liability under this contract is limited to the amount paid by the Buyer for the Product.
  3. Nothing in these Terms limits rights that cannot be limited under the consumer protection law that applies to the Buyer.

8. Personal data

Personal data is processed according to the Privacy Policy.

9. Disputes and governing law

  1. The parties will try to resolve any dispute by negotiation. The Buyer can start by writing to bessmertnaya1609@gmail.com.
  2. This contract is governed by the law of Ukraine, without depriving the Buyer of protection under mandatory consumer law of their country of residence.

10. Changes and validity

  1. The Seller may update these Terms by publishing a new version on the Website. The version in force on the date of payment applies to that order.
  2. If these Terms are published in more than one language, both versions have equal force.
